GST - Flat purchased

hello Xossipians,

I am supposed to get Flat possession in coming months. Builder is demanding 18% GST on Society charges. is they any GST applicable before forming Society.

If no, how to challenge builder on this?

Also I paid 12% GST on outstanding amount after GST implement. now I am seeing on internet that these 12% can be reduced availing Input tax credit from builder. so is there any way how one common can challenge this. how to check if he got ITC and didn't passed on buyer?

waiting for your suggestion. also if you provide official link to support answer will be highly appreciated.

If it is a normal body with no registration no. then the builder can avoid GST, as nothing is official.

If the builder is forming a govt. registered society then GST will be implemented as per govt rule.

The best thing will be to consult your lawyer.

As a builder, he must be knowing more ways to escape if you charge him.
